Terms and Conditions
The following Terms and Conditions (T&C) apply to all services and contracts with Socintel FlexKapG.
1. Scope
(1) These Terms and Conditions apply in the version valid on the date of contract conclusion for all service contracts with Socintel FlexKapG. Deviating agreements require written form. By engaging our services, the client agrees to these T&C and is bound by them.
(2) Should individual provisions of these T&C be wholly or partially ineffective due to mandatory statutory provisions (in particular the provisions of the Austrian Consumer Protection Act — KSchG), the remaining provisions shall remain in full force and effect.
2. Conclusion of Contract
Socintel FlexKapG reserves the right to change the scope and content of its service offerings at any time. The contract is concluded upon acceptance of the order by Socintel FlexKapG, either by sending an order confirmation via email or by commencing the agreed services.
3. Contract Language
The contract content, all other information, customer service and complaint handling are offered in German and English.
4. Services
Socintel FlexKapG provides data management, analytics, and custom development services. The specific scope of services is defined in individual project agreements or service descriptions.
5. Prices and Payment
(1) The applicable prices are those agreed upon in individual project proposals or as published on the Socintel FlexKapG website.
(2) Invoicing is in Euros. Payment is due within 14 days of invoice date unless otherwise agreed.
(3) Response time for inquiries: inquiries are answered within 2 business days.
6. Warranty
Warranty is provided in accordance with statutory provisions.
7. Liability
Socintel FlexKapG is liable in accordance with statutory provisions. Liability for slight negligence is excluded to the extent permitted by law, except in cases of personal injury.
8. Intellectual Property
All intellectual property created in the course of providing services remains the property of Socintel FlexKapG unless otherwise agreed in writing. The client receives a non-exclusive right of use for the agreed purpose upon full payment.
9. Jurisdiction and Applicable Law
(1) Austrian substantive law shall apply to this contract, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For disputes, the court with subject-matter jurisdiction at the registered office of Socintel FlexKapG shall have exclusive jurisdiction. If the client is a consumer within the meaning of the KSchG, the jurisdiction of the court in whose district the domicile, habitual residence or place of employment of the client is located shall be deemed established.
(3) Place of jurisdiction and performance is the registered office of Socintel FlexKapG.
These T&C are valid as of March 2026.
